This is a direct post from a thread on Filmtracks.com... After disagreeing with his Everlasting Piece review, I posted mine... Goes as this:
"You give this a ** but there really isn't much explanation on the rating... I have listened to the CD about 10 or so times (hey, it's short!), and I found it to be fresh and enjoyable. Though me and a friend are just starting a site, you can check our review of An Everlasting Piece over at
http://www.soundtrackcinema.com/everlasting.htmlThe site is by no means finished, we just started... But any reviews are good reviews when it comes to scores I guess..."
In response, I get this...
"I can't pick out anything in Mr. Clemmensen's review where it explains why it deserves a 2 star rating. Its mostly just explains the story behind the score, but little on the score itself.
I've had this CD since its release, and I've had time to listen to it more than a few times. It is a very pleasant and sometime exciting listening experience, that doesn't fall into unlistenable noise. Each cue is contructed
as a piece of its own with an occasical central theme to tie it together. It is also a little of something new & different from the composer (actually Zimmer did some irish jig things in his score for "Fools of Fortune" but that was ten years ago!!)It is also something unique to the majority of movies out there, I mean is there a score like this? I don't think so. So that makes this score a bit above adverage. From what I understand Mr. Clemmensen also mentions that the theme is a rip of Titanic! Well I own Titanic, and am very familiar with it.
And the only thing simular is its use of bagpipes and other irish elements. Bagpipes can only play a certain amount of sounds, so its of no suprise that some irish melodies on bagpipes sound somewhat familiar. There is no direct rip off here.
An Everlasting Piece is a inventive and unique that is surely above adverage s, that offers a pretty good listen experience on CD, and a score such as that does not deserves a below adverage rating. The score deserves at least a 3½ star or a 4. It is ingenius but not briilant. My only real gripe is the amount of information in the packaging. There is nothing mentioned about the film nor the proscess of score the film. (what Mr. Clemmensen's review should have been used as).An Everlasting Piece (as heard on CD) ****"
OK Cool, then I get this...
"Looks like another Filmtracks.com design imitation is on the block!
Just wait 'til Ford A. Thaxton finds it. Ha!
"I then find a thread on the Filmtracks.com board (which sucks, btw, compared to this one)...
"Is this site related to the radio show "Soundtrack Cinema" in any way?
http://www.soundtrackcinema.com/I have heard the radio show think it would be great for its host to write score reviews like this.
Mark
"Someone replies:
"No, but it could be confusing. I'm surprised that Thaxton (the show's host) hasn't gone nuts over that site stealing his show's name and profiting by it.
The site looks like another rip-off of Filmtracks, too."
Pissed, I reply:
"Good lord! First of all, I'm the "designer" of Soundtrack Cinema if you'd like to call it that. First of all, I was never aware there was a show or whatever called Soundtrack Cinema... Me and my friend just wanted to do a site for the public and that's the name he came up with, I thought it sounded pretty good. Second of all, we have NO intention from profiting from it. I'm actually getting quite offended people think it simply as a "filmtracks" rip-off... Have you guys ever even seen another website? Clemenson obviously got ideas for his layout from other pages, just as I have... But whatever, think what you may, I just want to help others my having *more* score reviews for them to get at before they purchase a score. If that's a bad thing, sue me."
This guy AGAIN replies...
"You might want to expect a call from Mr. Thaxton... More reviews are always a good thing. Getting Thaxton upset, though, is not a good thing. Trust me."
I reply...
"May I ask who this Ford Thaxton is he? I have no clue... And why is getting him mad such a big deal, I haven't really done anything wrong... The domain was open , we took it =)"
Christian (Filmtracks.com host) replies :
"Ford has been notified about the site --he'll likely contact you about it if he is interested.
Christian"
Anyway that's it, what do you guys think of it? The one guy who says "getting him mad isn't good treats this Thaxton guy like a GOD, which he obviously isn't =)... I live in Seattle and don't even know who he is OR Soundtrack Cinema... AM I doing anything wrong here guys? We got an open domain, and are using the site for public interest... Does he have authority to take down the site? I don't know legal issues and such, but It doesn't seem that there would be anyway he could do anything about it... I'm confused. =)posted 01-13-2001 12:28 AM PT (US)

I don't know the legalities, maybe someone else can chime in on that one. I think the worse thing that could happen is that you might be asked to change your site name and might be able to say no and have done with it.As for Ford, he's involved with a lot of things soundtrack, and is known for having an acerbic temperament. I don't know if he can actually DO anything, but he loves to 'mix it' (although he is also very helpful and knowledgable to people at times as well).
I realize you didn't intentionally try to encroach on his turf and in the name of good conflict resolution I hope Ford realizes the same and blows it all off.

If this Ford guy wanted this URL, he would have registered the name years ago, so I think you'll be fine.Legally? If "Soundtrack Cinema" is a trademarked name and "soundtrackcinema.com" is not trademarked, and lawyers can drum up a strong case to prove there is public confusion, soundtrackcinema.com goes to its rightful owners. If no one has trademarks, Lou is right, you guys are just gonna have to work it out among yourselves (which is unfortunate, as this rarely happens when this Ford guy is involved). If you want to do it right legally, one of you better go get some trademarks and be prepared to prove the name is rightfully yours.
It's funny, though, that the soundtrackcinema.com owner is in Seattle, the very same town that the radio show "Soundtrack Cinema" broadcasts in. If this isn't a good example to prove there is no public confusion of the name, I don't know what is. The real confusion exists only on one or two message boards on the internet, hardly enough confusion to warrant a full-fleged legal case.

I'm not sure what Ford is like today, but in my limited dealings with him, I always found him ethical, generous, and reasonably fun to talk to. As with many other people I know and have known, I think the nature of the Internet simply brings out the worst in him. But then I personally have no "bad Ford" stories to tell, unlike that notorious, hair-raising memoir Lukas Kendall posted a couple of years back. I have a pretty nasty "bad Lukas" story or two as well, but that's all water under the proverbial bridge. I'm a champion grudge-holder, but am trying to be a better person.
